Rules and Regulations

1. Northport Rural Cemetery Association Incorporated, hereinafter referred to as the Association, operates under the Cemetery Law of the State of New York.

2. You are reminded that these grounds are sacredly devoted to the interment of the dead and a strict observance of the decorum, which should characterize such a place, will be required of all visiting this cemetery.

3. The proprietors of graves and their families will be allowed access to their graves subject to such rules and regulations and at such times as may be adopted by the Association.

4. All graves shall be held in pursuance of an act entitled, “An Act Relating to Membership Corporations” constituting chapter 35 of the Consolidated Laws, which became law February 17, 1909 and the acts amendatory thereof and supplementary thereto and shall be used for place for burial of dead human beings only.

5. Graves sold back to the Association will be purchased at the original cost price plus 4% simple interest each year owned, as provided by the Cemetery Law of the State of New York at a total price not to exceed the present selling price of a grave. Such graves may be purchased at the discretion of the Association.

6. No grave shall be transferred nor assigned without the consent of the Association endorsed of the conveyance.

7. Casket Vaults are required in Avenue A, Avenue B and Avenue D. Urn vaults are required for all ashes burials.

8. Funeral directors shall provide temporary markers for burials.

9. Owners shall not allow interments to be made in their graves for remuneration.

10. All outside contractors, workmen or landscapers employed, or retained by grave owners on the grounds of the Cemetery are subject to the control and direction of the Association and particularly of the Grounds Committee.

11. Mausoleums and structures may not be erected unless approved by the Association Board of Trustees.

12. The Cemetery has set standards for regular maintenance of all plots and grave areas and reserves the right to require the observance of the same standards for graves under the owners’ personal care.

13. All monuments must be set on a concrete foundation installed by the Association, according to its standards.

14. All monument inscriptions and monument foundation settings must be approved by the Association, with a written application and permit fee paid.

15. No monument shall exceed three (3) feet in height above grade except, as may be permitted by the Association. Monument widths shall be: single grave – no wider than 2’, double grave – no wider than 4’, triple grave or more – no wider than 6’.

16. Upon completion of any work completed by monument firms, the grave and adjoining graves must be left in a condition satisfactory to the Association.

17. All monument work must be of stone or standard bronze.

18. Interments and disinterments may be made only in accordance with the regulations of the NYS Board of Health and in compliance with Section 1510 (e) of N.F.P.O.

19. Notice of interment must be given at least 36 hours in advance at the Cemetery office. Burial permit or cremation certificate, deed or burial affidavit must be presented at time of burial. No burial shall take place without the proper documentation and payment for services provided.

20. All interments must be made under the supervision of a representative of the Association, who shall have sole discretion with respect to all matters relating to burials.

21. The Cemetery maintains the right to remove any stone or marker it has deemed necessary in order to open a grave for burial or disinterment.

22. The Cemetery shall conduct snow removal from all cemetery roads solely at the discretion of the Association.

23. The Cemetery reserves the right to close the Cemetery for any reason at its sole discretion.

24. These Rules & Regulations may be amended at any meeting of the Association upon the vote of two thirds (2/3) of the Trustees, approval by the NYS Division of Cemeteries and will be reposted.
